NAN LW_ <br />Town of Reading <br />ZONING BOARD OF APPEALS <br />- Minutes of September 4, 2008 <br />Members present: Paul Dustin <br />Robert Redfern <br />C= <br />r11 <br />Clark Petschek <br />Jeffrey Perkins <br />= . <br />John Miles <br />Peter Tedesco <br />> <br />John Jarema <br />Members Absent: <br />0 <br />A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the <br />Town Hall, 16 Lowell Street, Reading, Massachusetts, at 7:00 P.M. <br />Case # 08-16 <br />Continuation of a Public Hearing on the petition of Timothy Morrison who seeks a Variance <br />and/or a modification of Case # 07-16 under Section 5.2.9 of the Zoning By-laws in order to <br />construct a single family dwelling on the property located at West Street, Assessor's Map 96, <br />Lot 7, in Reading, MA. <br />The Chairman read a statement by Board member Peter Tedesco that will allow him to vote on <br />this case under M.G.L. Chapter 39, Section 23D (the "Mullin Rule"). He also read a letter from <br />Sally Hoyt in support of the application. <br />Attorney Brad Latham reviewed the memorandum that he had just submitted to the Board <br />addressing the concerns that were raised by the Board during the previous hearing and reviewed <br />the changes to the upland wetlands regulations. He listed their criteria as to why a Variance <br />should be granted. <br />Mr. Petschek stated that he thought the footprint of the proposed structure included on the <br />submitted plot plan might tie down the project and not be workable. Attorney Latham said he <br />had hoped that what was presented could be accepted conceptually and not be binding as to the <br />footprint. <br />Mr. Redfern stated that he thought Attorney Latham's presentation had answered the questions <br />he had raised at the last hearing. He wondered what Attorney Latham meant by a modest house <br />and Attorney Latham said it might be a cape or a split ranch. <br />ZBA Meeting, September 4, 2008 <br />
