ou~nl C~ER~ <br />Town of Reading <br />ZONING BOARD OF APPEALS <br />Minutes of August 6, 2009 <br />Members Present: Clark Petschek, Chairman <br />Robert Redfern <br />John Miles <br />John Jarema <br />Jeffrey Perkins <br />Damase Caouette <br />Members Absent: Peter Tedesco <br />M-CEIVED <br />TO' ' CLERK <br />,2000 SEP 21 P O 56 <br />A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the <br />Town Hall, 16 Lowell Street, Reading, Massachusetts, at 7:00 P.M. Also in attendance was Glen <br />Redmond, Commissioner of Buildings. <br />Case # 09-05 <br />Continuation of a Public Hearing on the petition of Lisa Mead, Blatman, Bobrowski & Mead, <br />- LLC; who seeks a Variance under Section 5.1.2 of the Zoning By-laws in order to allow the <br />owner (Kevin Fulgoni) to construct a single family dwelling on the property identified as Lot A, <br />South Street in Reading, MA. <br />Attorney Lisa Mead represented Kevin Fulgoni who also attended the meeting. Attorney Mead <br />reviewed the case and all that had taken place to date concerning this property. She reviewed the <br />hardships that were perceived by her and Mr. Fulgoni due to the taking by the state of a portion <br />of this property in order to build Route 128. <br />The Board asked some questions regarding the date of purchase by Mr. Fulgoni, and the <br />compensation paid to the then owners at the time of the taking. It was noted by the Board that the <br />lot was always sold at a reduced price after the land taking by the State due to the decreased lot <br />size. Attorney Mead contended that what made the lot non-conforming was when the Town <br />rezoned. <br />There is also litigation still pending regarding whether this lot is a buildable lot, but Attorney <br />Mead pointed out that does not affect this appeal before the Board. <br />There was some discussion regarding the uniqueness and hardship relating to this lot in its <br />present state and the Board thought these qualities were not present in this property. Criteria one <br />and three presented problems to the Board who felt there was no justification. <br />Paula Gentile of 393 South Street voiced her objections to the proposed project. <br />ZBA Meeting 08-06-09 <br />
