T~m CLFkx- <br />Town of Reading <br />ZONING BOARD OF APPEALS <br />Minutes of April 1, 2010 <br />Members Present: Clark Petschek, Chairman <br />Robert Redfern <br />Damase Caouette <br />Peter Tedesco <br />Members Absent: John Jarema <br />John Miles <br />Jeffrey Perkins <br />i.i <br />2010 JUIR I A 1 <br />A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the <br />Town Hall, 16 Lowell Street, Reading, Massachusetts, at 7:00 P.M. Also in attendance was Glen <br />Redmond, Commissioner of Buildings. <br />Other Business: <br />18D Carnation Circle - Determination if Major/Minor Modification <br />Kate Jessup of Red Apple Builders presented her proposal to the Board for 18D Carnation Circle <br />and the partially enclosed porch. They are only adding a partial roof to the present structure and <br />are not increasing the footprint. <br />The Building Inspector does not have any concern with this particular project but there are 90 <br />units and he thinks there will be many more to follow appearing before the Board. He also said <br />there are many units that have done this in the development without appearing before the Board, <br />some with permits and some without. Mr. Redmond would like the Board to decide if they will <br />allow this in the other units also so that he can issue permits by right. <br />The members gave their opinion as to whether they felt that this type of modification was a <br />minor or major modification. They did feel that any future cases should be brought before the <br />Zoning Board. An existing roof with a deck under it can have screens or glass and not be a major <br />modification. All other modifications, such as a second level, must come before the Board. <br />There was some question as to whom would own these "rooms" since these are considered <br />common areas and are owned by the Condo Board. Richard Nazzaro said the enclosed decks are <br />maintained by the unit owners even though they don't own them. He said all owners have to sign <br />alteration agreements if they are altering the common areas in any way. <br />After more discussion, the Board concluded that all enclosure projects, whether or not the <br />proposed enclosure entailed adding screening or windows to an existing deck, must come before <br />the Zoning Board. <br />ZBA Meeting, April 1, 2010 <br />
