Minutes of the Executive Session <br /> Board of Selectmen Meeting <br /> May 15, 1990 <br /> The executive session was convened at 9:20 p.m. Present were <br /> Chairman Russell Graham, Vice Chairman Dan Ensminger, Secretary <br /> George Hines, Selectman Eugene Nigro and Town Manager Peter <br /> Hechenbleikner. <br /> Section 1. <br /> Town Manager reviewed the issues with regard to an unfair labor <br /> practice filed against the Town for the Town Manager's and <br /> Selectmen's failure to recommend to the Finance Committee and the <br /> Board of Selectmen the inclusion of two firefighters making up a <br /> total number of 43 firefighters in accordance with the contract. <br /> The Town Manager recommended that these two positions be added at <br /> a total net cost of $53,484. On motion by Nigro, seconded by <br /> Hines and a roll call vote all four members voting in the affirm- <br /> ative, the Board voted to support the Town Manager's recommenda- <br /> tion with regard to this. <br /> Section 2 <br /> The Town Manager reviewed the status of litigation or potential <br /> litigation with RESCO. On motion by Ensminger, seconded by Nigro <br /> the Board voted to approve the following procedures as outlined <br /> in the Town Manager's memo 5/15/90: <br /> 1. That the Town agree to sign a letter with the other com- <br /> munities indicating that we will be staying with our current <br /> contract with RESCO for FY91 and reiterating what the con- <br /> tract means in terms of procedures and dollars. <br /> 2. That the communities will enter into litigation with RESCO <br /> seeking declaratory judgment that our understanding of the <br /> contract is valid. <br /> 3 . That the communities enter into negotiations with RESCO in a <br /> long-term contract beginning July 1, 1991. <br /> 4. That the Town will support financially up to $30,000 a year <br /> for two years the cost of litigation and negotiations. <br /> This motion was approved on a roll call vote with all four mem- <br /> bers voting in the affirmative. George Hines asked what would <br /> happen if other communities back out. The Town Manager indicated <br /> that it would have an effect only in the area of additional costs <br /> of litigation. <br /> On motion by Ensminger, seconded by Nigro the Board voted to go <br /> into open session at 9:40 p.m. with all four members voting in <br /> the affirmative by vote of 4-0-0. <br /> Respectfully s� mitted, <br /> ecret, y <br />
