The machine is to be brought inside at night. <br />After reviewing the food code, Friedmann made a motion to grant the variance, seconded by <br />Singer. Approved 3:0 <br />Discussion Regarding Board of Selectmen's Meeting <br />Marsie West stated she had concerns that the revision to the Regulation Restricting the Sale <br />of Tobacco Products and Nicotine Delivery Products happened too quickly and the Board of <br />Selectmen were not informed. She did not understand the health benefit to increasing the <br />age from 18 to 21 to purchase these products. She stated the concerns of the Board of <br />Selectmen that customers will go to other towns to purchase tobacco and other products <br />which will affect local businesses. <br />Clay explained the role of the Board of Health (BOH) is set by state statutes. Public health <br />hearings are only required for Title V; however, this Board does hold public hearings for all <br />new and revised regulations and puts a Legal Notice in the newspaper the week in advance. <br />This public hearing was in the February monthly report, a Legal Notice was published in the <br />Daily Times Chronicle, a letter was sent to all affected businesses, the agenda was posted at <br />Town Hall and on the Town website. Singer stated that he was concerned about the tone of <br />the Selectmen's remarks which he characterized as suspicious. Friedmann also agreed. <br />Singer stated the BOH reviewed all the relevant health Information provided by RCASA, Dr. <br />Lester Hartman, MA Association of Health Boards and the director of the Brookline tobacco <br />collaborative, and had a joint discussion with BOH members of Melrose and Wakefield. <br />Based on that information, he voted in favor of this change for the protection of the health <br />and well -being of the residents In the Town of Reading. <br />Page 1 1 <br />
