By -Law Committee Minutes # 112 <br />May 28, 1987 <br />Members Present: Ed Murphy, Chairman, George Theophanis, Phil Pacino, <br />Dolores Carroll and Nils Nordberg <br />7:30 p.m. Chairman Murphy called the meeting to order and opened <br />a Public Hearing on the subject of the Committee's proposed <br />revisions of the General By -Laws of the Town, appropriate <br />to bringing the By -Laws into conformity with the Town of <br />Reading Home Rule Charter. Members of the public present <br />were Mollie Ziegler and Virginia Adams. Chairman Murphy <br />outlined the work of the Committee to date and made available <br />to the public copies of the most recent working draft of the <br />revised by -laws. Chairman Murphy then opened the floor to <br />questions and comments from the public. <br />Mollie Ziegler raised questions concerning the capital <br />improvement program and expressed her concern regarding <br />the Charter requirement for a program to be prepared preparatory <br />to the operating budget whereas the by -laws would require a <br />capital improvement program be submitted to the Fall Town <br />Meeting. Following some discussion among the members of the <br />Committee and Mrs. Ziegl::.,, Nils Nordberg moved, and Phil <br />Pacino seconded,that Article 4 be amended by inserting at <br />the beginning of the first sentence the words: AFTER SUBMISSION <br />OF THE CAPITAL IMPROVEMENT PROGRAM TO THE SELECTMEN AND THE <br />FINANCE COMMITTEE and by deleting from the first sentence the <br />words A FIVE YEAR IMPROVEMENT and the fifth sentence to be <br />SECTION 1, the first four sentences to be SECTION 2 and the <br />second and third sentences to be SECTION 3. <br />VOTE: 5 -0 -0 APPROVED <br />Mrs. Ziegler also had a question regarding the repeal of. <br />Article 30. After some discussion it was agreed that the <br />amendments to the Charter at November '86 Town Meeting resolved <br />the issues with which she was concerned. <br />Virginia Adams expressed some concerns regarding Article 2. <br />There being no apparent conflict between by -laws and the <br />Charter in this regard the Committee assured Mrs. Adams <br />that the subject of her concerns would be considered when <br />the Committee undertakes to recodify the by -laws. Mrs. Adams <br />j also had some questions regarding Section 4 of Article XIV. <br />Again, there being no conflict between Charter and By -Laws, <br />it was agreed that this subject would be taken up when the <br />Committee addresses the recodification of the by -laws. <br />There being no other comments or questions from the public <br />Chairman Murphy thanked Mrs. Ziegler and Mrs. Adams for their <br />interest and time in attending and closed the Public Hearing. <br />The Committee then convened to review the newest revisied <br />draft, made several punctuation corrections and requested <br />
