Town of Reading <br />ZONING BOARD OF APPEALS <br />Minutes of January 5, 2012 <br />Members Present: Jeffrey Perkins, Chairman <br />Robert Redfem <br />John Jarema <br />Damase Caouette <br />John Miles <br />Members Absent: Kristin Cataldo <br />RECEIVED <br />TOWN CLERK <br />READING, MASS. <br />2012 MAR 13 A 8: Ob <br />A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the <br />Town Hall, 16 Lowell Street, Reading, Massachusetts beginning at 7:00 P.M. Also in attendance <br />was Glen Redmond, Commissioner of Buildings. <br />Case # 11 -26 <br />A continuation of a Public Hearing on the petition of McNeil Builders LLC who seek a Variance <br />under Section(s) 5.1.2 of the zoning bylaws in order to construct a deck 10' x 12' that encroaches <br />into the required side yard setback of 15.0' on the property located at 49 Weston Road in <br />Reading, MA. <br />Michael McNeil, agent for the owners /applicants, Stephen & Wendy Gallante, presented the <br />revisions made to the plot plan and the deck has now been reduced in size to 8.5' x 12' and the <br />addition reduced by 7inches to meet the required setback so they can request a Special Permit <br />instead of a Variance. <br />With the revised plot plan, there are no new non - conformities. The Special Permit should be <br />requested under Section 6.3.2 of the Zoning By -laws and the Applicant, Mrs. Gallame, requested <br />that her Special Permit request be done under this section. The Board members agreed that this <br />was the correct section for the Special Permit and the petition with the revised plot plan appeared <br />straightforward. <br />The Building Inspector said the size of the deck was adjusted on the revised plot plan to comply <br />with the zoning by -laws setback requirements. <br />On a motion by Robert Redfern, seconded by John Jarema, the Zoning Board of Appeals moved <br />to grant the Applicants a Special Permit under Section 6.3.3.2 of the zoning bylaws in order to <br />demolish the existing deck, construct a new 12' x 8.5' deck and construct a 14' x 11.5' x 12' <br />addition at the northwesterly comer of the existing dwelling, as depicted on the referenced <br />revised Plot Plan prepared and stamped by Leo. B. White, R.L.S. and dated December 9, 2011 <br />
