BYLAW COMMITTEE MINUTES #300 <br />Wednesday, June 8, 2011 <br />Meeting called to order at 7:05 p.m. in the Town Hail Conference Room. <br />Members rp esent: Louise C. Callahan, Ron O'Keefe, Jr. and Dolores Carroll. <br />Also Present: Town Manager Peter Heckenbleickner and Town Counsel Ellen Callahan Doucette. <br />The meeting began with an overview of Article 8, confirming changes made at the previous meeting <br />and continuing with the following: <br />- Discussion of Section 8.3.7 Enforcement and Section 8.4.6 Violation and Enforcement <br />postponed to a later date. <br />- The previous language in the Anti Litter section which did not allow flyers to be placed on <br />windshields, is being reinstated. <br />- In Section 2: Definitions of the News Racks Bylaw, "bylaw" has replaced "Ordinance" in <br />paragraph (a) and "the Board of Selectmen or its designee" has replaced the <br />"Commissioner of the Public Works Department" in paragraph (1). Attorney Doucette <br />will review this section and Peter will e -mail a copy of the Definitions section to each <br />Committee member as soon as completed. <br />- Attorney Doucette worked on the language of 1.7 Enforcement, and added a new section 1.8 <br />Non - criminal Disposition of Certain Violations of Bylaws, which includes a table <br />establishing penalties for violations, and identifies the enforcing person. <br />- 1.7.2, 1.7.3, 1.7.4 and 1.7.5 have been deleted as they are part of the state statute; therefore, <br />there is no need for repetition. <br />Attorney Doucette is expected to seek the approval of the Attorney General's office prior to the <br />preparation of the final draft of the recodification. <br />Peter Heckenbleickner informed the Committee that a legal notice, along with a website, will be <br />published in the local newspaper on June 13th <br />A public hearing is expected to be held on July 6th, with July 13" being the date expected to finalize <br />the recodification, which is four (4) months prior to the November 14' Subsequent Town Meeting. <br />Minutes #299 were read, and on motion of Ron O'Keefe, Jr., seconded by Louise C.
